are service dogs seen as pets or property in an apartment?
an apartment allows only two dogs as pets. lets say i have two pet dogs, but i am in need of a trained service dog for my disability would that service dog be seen as another pet dog bringing me to a total of three dogs? or can I legally own a service dog as property like a wheel chair or crutch and two pet dogs in an apartment whose rules are that we can only have two dogs as pets.

Maybe, maybe not. It is not explicitly addressed in statutory or regulatory law. There may be some case law, but if so, I haven’t seen it. I collect case law involving service dogs, so I think it likely I would have run across such a case if it existed on the federal level. I can’t account for individual state laws, especially without knowing the state involved.
If you’re talking about fighting something like this out in court, I think you’d be unlikely to win. You’d not only have to convince the judge you qualify legally as disabled, and that the additional dog qualified as a service dog, but that you couldn’t rehome one of the other dogs as well. I don’t see many judges buying all three. In court your proof must be of a higher standard than with your landlord.
If you already have a history with the landlord and he knows you take good care of your dogs, that you clean up for them promptly, that they don’t disturb neighbors, a reasonable landlord would probably not have an issue with it in the situation you described. If, however, you’ve had some problems in the past with responsible dog ownership, I’d fully expect them to resist it and to win in court.

I wouldn’t look at this in terms of preparing for a battle you are unlikely to win. Instead, see if you can come to a reasonable agreement with the landlord.
I agree that it is unlikely a program would place a service dog in a home that already has two pet dogs. A service-dog-in-training counts as a pet until it is fully trained.

An afterthought: not all housing falls under the protections afforded by the Fair Housing Amendments Act. This would also affect whether one had a right to get a service dog, even if they had no pet dogs already. Again, HUD can explain which housing is covered and which is not.
